STANDARD TERMS AND CONDITIONS OF SERVICE

for Mechanic On The Go — Effective Date: January 1, 2025

1. Definitions

  • Mechanic On The Go (MOTG): Mechanic On The Go Auto Workshop, its management, employees, agents, or authorized representatives.
  • Customer: Any individual, organization, or entity engaging MOTG for inspection, repair, or related service.
  • Vehicle or Item: Any vehicle, engine, or mechanical/electrical component handled by MOTG.
  • Services: Diagnostic, repair, inspection, towing, delivery, maintenance, and advisory activities performed by MOTG.
  • Invoice / Job Card / Quotation: Official documentation summarizing work scope, estimate, and terms.

2. Scope of Agreement

  1. These Terms apply to all services rendered—workshop, customer location, or affiliate partners.
  2. Any modification not in writing and signed by management is invalid.
  3. Private or informal arrangements between staff and customers are not recognized.

3. Formation of Contract

A binding contract is formed once a Customer either signs or accepts a quotation/invoice/job card or makes a payment/deposit. Payment or authorization constitutes full acceptance of these Terms.

4. Quotation Validity and Price Review

All quotations, invoices, and estimates are valid for seven (7) days. After this period, prices may be reviewed due to market or currency fluctuations; revised estimates will be communicated before continuation of work.

5. Deposit, Payment, and Release Policy

  1. A non-refundable deposit of seventy-five percent (75%) of the total estimate is required before commencement.
  2. The remaining twenty-five percent (25%) must be paid immediately upon completion and before release.
  3. The 75% deposit covers committed labour, diagnostics, parts procurement, and logistics and is strictly non-refundable once work commences.
  4. For imported parts or specialized jobs, full (100%) advance payment may be required.
  5. No vehicle or item shall be released until all invoices, including storage or administrative costs, are cleared in full.

6. Non-Refund Policy

All payments made for parts, labour, diagnostics, or services are non-refundable once work begins. No refund applies to cancelled or altered jobs after commencement. Any approved refund must be authorized in writing by management and may be subject to deductions.

7. Proof of Ownership and Authority

  • Customers must provide valid government ID and proof of ownership.
  • Agents must provide written authorization.
  • MOTG will not release property to any third party without proper verification.
  • Customers shall indemnify MOTG against claims from false or disputed ownership.

8. Possessory Lien and Right of Retention

MOTG retains a possessory lien on all vehicles, engines, or parts in its custody until all outstanding payments, including storage or legal fees, are made in full. Only a valid court order or written indemnity accepted by management shall authorize release.

9. Storage, Abandonment, and Disposal

  1. Seven (7) days of free storage after notification of completion.
  2. Thereafter: ₦5,000/day for vehicles, ₦2,000/day for loose parts.
  3. After thirty (30) days of non-collection, MOTG may issue a 21-day notice, then sell, scrap, or dispose of the item. Sale proceeds offset outstanding costs; any balance held for ninety (90) days before forfeiture.

10. Job Authorization, Variations, and Communications

  • Every job must be authorized in writing or via verified electronic approval.
  • Additional work or variations must be confirmed in writing.
  • Official communications will be via designated business channels.
  • Customers must keep contact details accurate and reachable.

11. Home, Office, and On-Site Inspections

  1. Mobile/on-site services are by request and scheduling only. Call-out/inspection fees apply and are non-refundable.
  2. Customer must ensure safe and accessible work environment.
  3. MOTG not liable for damage arising from unsafe conditions, third-party interference, or customer negligence.
  4. Technicians are not authorized to accept cash beyond officially invoiced amounts. Payments for on-site services must be made to the company bank account.
  5. Parts removed during on-site repair remain property of MOTG until full payment.
  6. If towing to workshop is required, additional charges apply and workshop terms take effect on arrival.

12. Inspection, Diagnosis, and Acceptance

  1. Inspection/diagnostic fees are distinct from repair charges.
  2. Customers must inspect vehicles upon collection.
  3. Complaints must be made in writing within 48 hours of collection; after that, the job is deemed accepted.
  4. MOTG not responsible for any malfunction or damage after the vehicle leaves custody.

13. Limitation of Liability

MOTG’s total liability for any loss, damage, or claim shall not exceed ₦500,000. MOTG shall not be liable for consequential losses, loss of profit, or third-party claims. Customer-supplied parts are at the customer's risk.

14. Customer Conduct and Safety

Customers must not interfere with staff or operations. Unauthorized entry into restricted areas is prohibited. MOTG may refuse service to persons engaging in harassment or abuse.

15. Staff and Third-Party Interference

Customers shall not privately hire MOTG staff for off-record jobs; MOTG is not liable for losses arising from unauthorized side engagements.

17. Force Majeure

MOTG is not liable for delays or damages arising from events beyond its control, including strikes, supply shortages, power failures, acts of God, or government action.

18. Confidentiality and Data Protection

  • Customer information will be collected and stored securely for service purposes.
  • MOTG will comply with the Nigeria Data Protection Act when handling personal data.
  • Data will not be shared except as required by law or for legitimate service delivery.

19. Intellectual Property

All reports, diagnostics, quotations, and service materials remain the intellectual property of MOTG. Reproduction or use for competitive or unauthorized purposes is prohibited.

20. Dispute Resolution and Jurisdiction

  1. All disputes shall first be referred to arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act.
  2. MOTG reserves the right to seek urgent relief in a court of competent jurisdiction.
  3. Nigerian law shall govern these Terms.

21. Severability

If any clause is found invalid or unenforceable, the remainder of the Terms shall continue in force.

22. Updates and Version Control

MOTG may revise these Terms periodically. The version in effect at the time of payment or authorization shall apply.

23. Acceptance

By signing a job card, quotation, or invoice, or by making payment, the Customer confirms they have read, understood, and accepted these Terms as published at www.mechaniconthego.com.ng/terms.
